This article was based on identifying violations of the principle of equality and equity in men who are victims of violence in Peru, Bolivia, and Colombia. They have experienced the consequences of a system that, while focused on combating gender-based violence, overprotects and oversaturates it, affecting the justiciability of violence against men. The objective was therefore to analyze how the gender approach implicates the equality and equity of men in the context of violence. The methodology used was a qualitative approach, based on documentary analysis and interviews as techniques. As a result, it was concluded that equity does not mean an absolute preference for one gender, male or female, but rather the search for balance, seeking the justiciability of domestic violence equally, avoiding labels or prejudices against men that obstruct their protection as victims of violence. It was concluded that the principle of equality and equity allows for a gender and preference approach for a social group within the limits of not harming other fundamental rights and not abusing them, and the fight against domestic violence is a priority for both genders.
